This Policy is in addition to any other restrictions found in applicable terms and conditions or agreements for Small Business or Enterprise services. All capitalized terms used in this Policy that are not defined here have the meanings given in the applicable Small Business and Enterprise Services agreements (collectively, “Business Services Agreements”). All customers of Go Business Internet and anyone using the Service (the “customer,” “user,” “you,” or “your”) must comply with this Policy. Failure to comply may result in the suspension or termination of your Service account, and associated charges may apply. Therefore, it is essential to ensure that all end users using the Service are aware of this Policy and agree to follow it. If your business does not agree to comply, it must immediately cease all use of the Service and notify Go Business Internet to close your account.
This Policy applies to your use of the Service if you are a Go Business Internet customer accessing Wi-Fi-identified services inside or outside of your premises or in public places using a Go Business Internet login and password. Go Business Internet may revise this Policy periodically by posting a new version on the website by communicating it through other means. Go Business Internet will make reasonable efforts to inform customers of any changes, which may include email announcements or updates on the Go Business Internet website. Revised versions of this Policy take effect immediately upon posting. Therefore, customers should read any announcements from Go Business Internet and regularly check the Go Business Internet website to ensure their activities align with the most current version. In general, the Policy prohibits uses and activities involving the Service that are illegal, infringe upon the rights of others, or interfere with or diminish the use and enjoyment of the Service by others. For example, prohibited uses and activities include using the Service, Customer-Provided Equipment, or Go Business Internet Equipment, either individually or in combination, to undertake or accomplish any unlawful purpose. This includes posting, storing, transmitting, or disseminating information, data, or material that is libelous, obscene, unlawful, threatening, or defamatory, or that infringes on the intellectual property rights of any person or entity. Additionally, any conduct that encourages behavior that would constitute a criminal offense or violate any local, state, federal, or non-Canadian law, order, or regulation is also prohibited. Customers must not post, store, send, transmit, or disseminate any information or material that a reasonable person could deem unlawful. They are also prohibited from uploading, posting, publishing, transmitting, reproducing, creating derivative works of, or distributing information, software, or other materials obtained through the Service or otherwise that are protected by copyright or other proprietary rights, without obtaining the necessary permission from the owner. Furthermore, it is not permissible to transmit unsolicited bulk or commercial messages, commonly known as “spam.” Customers should refrain from sending large numbers of copies of the same or substantially similar messages, empty messages, or messages that contain no substantive content. Sending large messages or files that disrupt a server, account, blog, newsgroup, chat, or similar service is also prohibited. Participation in pyramid schemes or other illegal activities is not allowed. Customers should not engage in the collection of large numbers of email addresses, screen names, or other identifiers of others without their prior consent, a practice known as spidering or harvesting. The use of software, including “spyware,” designed to facilitate this activity is also forbidden. Additionally, collecting responses from unsolicited bulk messages is not acceptable. Using IRC (Internet Relay Chat) or other chat services to flood chats, or employing unattended clones, bots, or other automated programs to engage in chats, is strictly prohibited. Customers must not falsify, alter, or remove message headers, nor should they falsify references to Go Business Internet or its network in messages. Impersonating any person or entity, engaging in sender address falsification, forging anyone else’s digital or manual signature, or performing similar fraudulent activities, such as “phishing,” is also forbidden.
Go Business Internet prohibits accessing any other person’s computer or computer system, device, sensor, camera, network, software, or data without their knowledge and consent. Customers must not breach the security of another user or system or attempt to circumvent user authentication or security measures of any host, network, or account. This includes but is not limited to, accessing data not intended for your business, logging into or utilizing a server or account that your business is not expressly authorized to access, or probing the security of other hosts, networks, or accounts without explicit permission. Additionally, the use or distribution of tools or devices designed for compromising security, or whose use is otherwise unauthorized, is strictly prohibited. This includes password-guessing programs, decoders, password gatherers, keystroke loggers, analyzers, cracking tools, packet sniffers, encryption circumvention devices, or Trojan Horse programs. Unauthorized port scanning is also not allowed. Customers may not copy, distribute, or sublicense any proprietary software provided in connection with the Service by Go Business Internet or any third party, except that one copy of each software program may be made for backup purposes only. Distributing programs that make unauthorized changes to software, commonly known as cracks, is prohibited. Furthermore, customers must not service, alter, modify, or tamper with Go Business Internet Equipment or the Service, or permit any unauthorized person to do so.
Go Business Internet customers must not use the Service for operation as an Internet service provider or for any other business, legal entity, or organizational purpose, whether for profit or not. Customers are also prohibited from restricting, inhibiting, compromising, or otherwise interfering with the ability of any other person to use or enjoy the Service. This includes posting or transmitting any information or software that contains a worm, virus, or other harmful feature. Interfering with the performance of the Service or any Go Business Internet host, server, backbone network, node, or service, or causing a performance degradation to any Go Business Internet facilities used to deliver the Service, is strictly prohibited. Customers may not make the Service available to any third party without Go Business Internet’s written approval following an applicable Business Services Agreement. However, it is not a violation of this Policy for customers to make the Service available to authorized employees, contractors, or users in common or public areas of the site where the Service is received, provided that such use complies with the terms of the Business Services Agreement. Reselling the Service or making it available to anyone outside the designated Service Location(s) is not permitted unless expressly allowed by the applicable Business Services Agreement. Customers must not connect Go Business Internet Equipment to any computer or device outside of their Service Location(s). Additionally, customers may not interfere with computer networking or telecommunications services to any user, host, or network, which includes denial of service attacks, network flooding, service overloading, or attempts to crash a host. Finally, customers must not interfere with Go Business Internet’s ability to manage its network, including controlling or blocking ports for safety and security purposes, nor may they disrupt the use of Go Business Internet’s domain name server (DNS) utilized in connection with the Service. Accessing and using the Service with anything other than a dynamic Internet Protocol (IP) address that adheres to the dynamic host configuration protocol (DHCP) is also prohibited unless expressly permitted by the applicable Business Services Agreement.
In addition to being responsible for your compliance with this Policy, your business is also accountable for any use or misuse of the Service that violates this Policy, even if such actions were committed by an employee, contractor, customer, or guest with access to your Service account. Your business must actively prevent employees, contractors, customers, and guests from engaging in copyright infringement in connection with your Service account, and must comply with all notices and requests under the Digital Millennium Copyright Act (DMCA), 17 U.S.C. §512(c)(3), as well as applicable Canadian copyright laws. Your business should have processes in place for promptly addressing and responding to DMCA takedown notices. Upon reasonable request by Go Business Internet, your business shall provide information demonstrating your policies and practices for addressing DMCA violations related to your Service account and the personnel responsible for compliance. Your business is also responsible for securing any Customer-Provided Equipment and other equipment or programs not provided by Go Business Internet that connect to the Service, protecting them from external threats such as viruses, spam, botnets, and other forms of intrusion.
Go Business Internet reserves the right to refuse to transmit or post, and to remove or block, any information or materials that it deems, in its sole discretion, to violate this Policy or to be harmful to its network or customers using the Service. This applies regardless of whether such material is unlawful, as long as it violates this Policy. While Go Business Internet and its affiliates, suppliers, and agents are not obligated to monitor transmissions or postings made on the Service, they reserve the right to monitor these communications for Policy violations and to disclose, block, or remove them under this Policy, the Business Services Agreement, and applicable law.
The Service may not be used to communicate or distribute email or other forms of communication in violation of this Policy. Go Business Internet employs reasonable network management tools and techniques to protect customers from receiving and sending spam, which can often occur without their knowledge through infected computers. Go Business Internet is not responsible for deleting or forwarding any email sent to incorrect email addresses by your business or others trying to reach your business’s employees, contractors, or users. It is also not responsible for forwarding email sent to any account that has been suspended or terminated; such email may be returned to the sender, ignored, deleted, or stored temporarily at Go Business Internet’s sole discretion. If a Service account is terminated for any reason, all associated email (including any secondary accounts) hosted by or directed by Go Business Internet may be permanently deleted. If Go Business Internet believes that any subscriber name, account name, or email address (collectively, an “identifier”) may be used for misleading, fraudulent, or other improper or illegal purposes, it reserves the right to block access to and prevent the use of such identifiers. Go Business Internet may also require customers to change their identifiers at any time and reserve identifiers for its purposes. Go Business Internet Service plans to limit the storage of messages on its systems. Neither Go Business Internet nor its suppliers shall have any liability for the deletion of, or failure to store, messages, or for the misdelivery, failure to deliver, or untimely delivery of messages. Go Business Internet employs various virus detection and prevention tools that are frequently updated to respond to the latest Internet threats. These tools automatically remove viruses and other unwanted materials from emails whenever possible, applying to both emails your business sends and receives. Additionally, Go Business Internet may scan all incoming and outgoing email traffic over the Service using automated tools that apply recognized and commonly used techniques for identifying and blocking spam and other unwanted or harmful content.
Each user is responsible for the content of their instant, video, and audio messages, as well as the consequences of those messages. Go Business Internet assumes no responsibility for the timeliness, misdelivery, deletion, or failure to store these messages. If a Service account is terminated for any reason, all instant, video, and audio messages associated with that account (and any secondary accounts) will be permanently deleted.
Go Business Internet provides the Service for your business’s use. Everything your business does using the Service is directly attributable to it and can affect its reputation. Additionally, because Go Business Internet owns the systems delivering the Service, activities performed via the Service may also impact its reputation. For instance, if your business uses the Service to send spam (or what is classified as spam by reporting services), it could damage Go Business Internet’s reputation due to its ownership of the associated IP addresses. Such activities violate this Policy. Go Business Internet reserves the right to suspend or terminate Service accounts if your business’s use negatively impacts its reputation, as determined at its sole discretion. Any use of the Service that results in your business’s Service account or any associated Go Business Internet information being listed on spam reporting websites may lead to account suspension or termination. In such cases, Go Business Internet prefers to work directly with your business to address issues causing harm to its reputation.
Go Business Internet manages its network with the ultimate goal of delivering the best possible broadband Internet experience to all customers. High-speed bandwidth and network resources are finite, so effective management is essential to promote the use and enjoyment of the Internet. Go Business Internet employs reasonable network management practices consistent with industry standards, utilizing minimally intrusive tools and technologies deemed among the best in class. These practices will evolve alongside Internet usage and emerging challenges. The need for network management extends beyond Go Business Internet; all large Internet service providers engage in similar practices. Without effective network management, customers would face negative impacts from spam, viruses, security attacks, and network congestion. By practicing responsible network management and enforcing this Policy, Go Business Internet aims to provide the best possible broadband Internet experience to all customers.
Go Business Internet employs various tools and techniques to manage its network and deliver the Service. These dynamic tools and techniques can change based on network conditions and usage. Network management activities may include
(i) Identifying and preventing spam delivery to customer email accounts.
(ii) Detecting malicious Internet traffic to prevent the spread of viruses or harmful content.
(iii) Utilizing other necessary tools to ensure the best possible broadband Internet experience for all customers.
The Service is intended for commercial use only in small, medium, or large businesses as defined by the applicable Business Services Agreement. Therefore, Go Business Internet reserves the right to suspend or terminate Service accounts where data consumption does not align with typical commercial user behavior, as determined at the company’s sole discretion, or where it exceeds published data consumption limitations. Common activities that may lead to excessive data consumption include but are not limited to, numerous or continuous bulk transfers of files and high-capacity traffic using (i) file transfer protocol (“FTP”), (ii) peer-to-peer applications, and (iii) user-generated content sites. Your business must ensure that its use of the Service does not restrict, inhibit, interfere with, or degrade any other person’s use of the Service, nor should it represent (as determined by Go Business Internet in its sole discretion) an excessive burden on the network. Additionally, your business must ensure that its use does not limit or interfere with Go Business Internet’s ability to deliver and monitor the Service or any part of its network. If your business uses the Service in violation of these restrictions, it constitutes a breach of this Policy and the Business Services Agreement. Go Business Internet’s determination of data consumption for Service accounts is final.
Go Business Internet reserves the right to immediately suspend or terminate your business’s Service account and terminate the Business Services Agreement if you violate the terms of this Policy or the Business Services Agreement, or if any of your end users violate this Policy or the Business Services Agreement.
Go Business Internet has no obligation to monitor and does not routinely monitor the Service and/or the network for violations of this Policy. However, Go Business Internet and its suppliers reserve the right at any time to monitor bandwidth, usage, data consumption, transmissions, and content to operate the Service, identify violations of this Policy, and protect the network, the Service, and Go Business Internet users. Go Business Internet prefers to inform customers of inappropriate activities and provide them with a reasonable period to take corrective action. It also encourages customers to resolve any disputes or disagreements directly, without Go Business Internet’s intervention. However, if the Service is used in a manner that Go Business Internet or its suppliers believe, at their sole discretion, violates this Policy, they may take any responsive actions they deem appropriate under the circumstances, with or without notice. These actions may include but are not limited to, temporary or permanent removal of content, filtering of Internet transmissions, and immediate suspension or termination of all or any portion of the Service. Neither Go Business Internet nor its affiliates, suppliers, or agents will have any liability for these responsive actions. These actions are not exclusive remedies, and Go Business Internet may pursue any other legal or technical actions it deems appropriate, with or without notice. Go Business Internet reserves the right to investigate suspected violations of this Policy, including gathering information from the user or users involved and the complaining party, if any, and examining material and data on Go Business Internet’s servers and network. During an investigation, Go Business Internet may suspend the account or accounts involved and/or remove or block material that potentially violates this Policy. Your business expressly authorizes and consents to Go Business Internet and its suppliers cooperating with (i) law enforcement authorities in the investigation of suspected legal violations, and (ii) system administrators at other Internet service providers or other network or computing facilities to enforce this Policy. Upon termination of your business’s Service account, Go Business Internet is authorized to delete any files, programs, data, email, and other messages associated with your business’s account (and any secondary accounts). The failure of Go Business Internet or its suppliers to enforce this Policy, for any reason, shall not be construed as a waiver of any right to do so at any time. Your business agrees that if any portion of this Policy is held invalid or unenforceable, that portion will be construed consistent with applicable law as nearly as possible, and the remaining portions will remain in full force and effect.
